One of the most draconian footballer-style gagging orders ever issued has been handed down by the High Court.
The media is even banned from reporting whether the person trying to hush up a secret is a celebrity or not.
Known only as KJH, they are at the centre of a dramatic case concerning ‘stolen and confidential information’ which a blackmailer threatened to reveal.
A senior judge, Mrs Justice Sharp, said the reason for the secrecy was to prevent the victim’s identity becoming known to the public. They had a right to privacy and there was no public interest in revealing details, the judge said.
The order is the latest in a string of injunctions which legal experts fear are eroding the principle of open justice.
Millionaire footballers and celebrities have been using the courts to hush up extra-marital affairs and other misdemeanours in their private lives.
But in the case of KJH, the judge said even if the ‘confidential information’ was known, it would not reveal any wrongdoing.
‘It does not reveal that KJH was conducting an extra-marital affair, or any other affair, nor does it reveal wrongdoing of any description (sexual or otherwise) by KJH or any other person,’ she said.
An injunction was justified as there is an ongoing risk the information stolen from KJH will be made public, the judge added.
